Terms of Service

These Terms of Service (“Terms”) govern your use of the Viotto platform operated by VT Wyatt LLC (“Company,” “we,” “us,” or “our”), located in San Clemente, California. By creating an account or using Viotto, you agree to these Terms.

1. Account Registration

You must provide accurate and complete information when creating your account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must be at least 18 years old to use Viotto.

2. Subscription and Billing

  • Free trial: New accounts receive a 14-day free trial with full platform access. You must provide a valid payment method to start your trial. You will not be charged during the trial period.
  • Billing: After your trial ends, you will be billed automatically at the rate for your selected plan (Starter, Pro, or Complete). Billing occurs monthly on the anniversary of your trial end date.
  • Plan changes: You may upgrade your plan at any time; upgrades take effect immediately and you will be charged the prorated difference. Downgrades take effect at the start of your next billing cycle.
  • Cancellation: You may cancel your subscription at any time from your dashboard. Your access continues through the end of the current billing period. No refunds are issued for partial billing periods.
  • Payment failures: If a payment fails, we will attempt to charge your payment method again. If payment is not received within 7 days, your account may be suspended.

3. Platform Services

Viotto provides automated marketing services for healthcare practices, including but not limited to:

  • Competitive intelligence analysis
  • Website design, development, and hosting
  • Search engine optimization (SEO)
  • Blog content generation and publishing
  • Reputation monitoring (Pro and Complete plans)
  • AI receptionist services (Complete plan)

We reserve the right to modify, update, or discontinue features with reasonable notice.

4. Your Content and Data

  • Ownership: You retain ownership of all content you provide (logos, images, text, business data). You grant us a license to use this content to provide Viotto services.
  • Generated content: Content generated by our platform (blog articles, website copy, SEO metadata) is licensed to you for use on your Viotto-managed properties. This license continues even after cancellation for content already published.
  • Data portability: You may request an export of your data at any time by contacting support.

5. Acceptable Use

You agree not to:

  • Use Viotto for any unlawful purpose or in violation of healthcare regulations
  • Provide false or misleading business information
  • Attempt to access other users' accounts or data
  • Interfere with or disrupt the platform's infrastructure
  • Resell or redistribute Viotto services without our written consent
  • Use the platform to send spam or unsolicited communications

6. Website Hosting and Domain

Websites built by Viotto are hosted on our infrastructure. You may connect your own custom domain. If you cancel your subscription, your website will remain live through the end of your billing period, after which it will be taken offline. You may request your website files before cancellation.

7. Limitation of Liability

To the maximum extent permitted by law, VT Wyatt LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of Viotto. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Disclaimer of Warranties

Viotto is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee specific marketing results, search engine rankings, or patient acquisition outcomes. Marketing results vary based on market conditions, competition, and other factors outside our control.

9. Indemnification

You agree to indemnify and hold harmless VT Wyatt LLC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of Viotto, your violation of these Terms, or your violation of any rights of a third party.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Orange County, California.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our platform at least 30 days before the changes take effect. Your continued use of Viotto after changes constitutes acceptance of the updated Terms.
